1. Introduction

These Terms and Conditions (“Terms”) govern your use of the Pinetown Funeral Services — Cape Town Branch website and your engagement of our funeral and related services. By using our website, requesting a quote, or engaging our services, you agree to be bound by these Terms, which are governed by the laws of the Republic of South Africa. Nothing in these Terms limits any right you have under the Consumer Protection Act 68 of 2008.

2. Our Services

We provide funeral-related services including, without limitation, collection, removal and storage of the deceased; supply of caskets and coffins; hearse and family car hire; burial or cremation coordination; death registration assistance; catering and floral arrangements; tombstones and memorials; bus, marquee, tent and décor hire; repatriation coordination; and, where applicable, funeral cover assistance through our authorised underwriting partner. Specific services will be set out in a written quotation before you are required to confirm and pay.

3. Quotations and Pricing

All quotations are free and without obligation, and clearly separate our service fees from third-party costs. Prices are quoted in South African Rand and valid for the period stated (or 14 days if unstated). Pricing may be adjusted where scope changes at the client’s request, subject to written agreement.

4. Payment Terms

Payment terms are set out in your written quotation or invoice. Where funeral cover is used to settle costs, payment is subject to the relevant policy’s terms and the underwriting insurer’s claims process, for which we are not responsible for third-party delays or shortfalls.

5. Cancellations and Changes

We understand circumstances can change quickly during bereavement. Please notify us as soon as possible of any cancellation or amendment. Third-party costs already incurred on your behalf may not be refundable. We act reasonably and in good faith in applying any cancellation terms, consistent with the Consumer Protection Act.

6. Client Responsibilities

You agree to provide accurate, complete information necessary for us to carry out the service. You are responsible for obtaining consent from other family members with a legitimate interest in the arrangements; we may pause arrangements where a dispute arises pending resolution.

7. Our Responsibilities and Standard of Care

We perform all services with reasonable skill, care, and dignity, in accordance with South African law, including the National Health Act 61 of 2003. Where we coordinate third-party suppliers, we do so as your agent/coordinator; certain aspects (e.g., cemetery availability, weather) may be outside our direct control. Nothing here excludes liability for gross negligence, wilful misconduct, or any liability that cannot lawfully be excluded under South African law.

8. Limitation of Liability

To the maximum extent permitted by law, our liability for any claim is limited to the value of the specific service giving rise to the claim, and we are not liable for indirect or consequential damages except where such exclusion is not permitted by law. This clause does not affect your statutory rights under the Consumer Protection Act.

9. Funeral Cover and Financial Services Disclosure

Where we assist you with a funeral policy, we work with Ingwe Life (Pty) Ltd, an authorized Financial Services Provider in South Africa with FSP Number 46004. Full policy terms, waiting periods, exclusions, and premiums are disclosed separately by Ingwe Life before you commit to any policy.

10. Intellectual Property

All content on this website is owned by or licensed to Pinetown Funeral Services — Cape Town Branch and may not be copied or distributed without prior written consent.

11. Website Use (ECTA)

This website is provided for informational purposes and to facilitate enquiries. In accordance with the Electronic Communications and Transactions Act 25 of 2002, electronic communications sent to and from us are treated as valid and binding, subject to applicable law.

12. Complaints

If unhappy with any aspect of our service, contact us directly so we can address your concerns promptly. You may refer unresolved complaints to the National Consumer Commission, and funeral cover complaints to the relevant insurer’s process, the Ombudsman for Long-Term Insurance, or the FSCA, as applicable.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa, subject to the non-exclusive jurisdiction of the South African courts.

14. Changes to These Terms

We may amend these Terms from time to time. The version published at the time of your enquiry or engagement applies; material changes to an already-confirmed service will be communicated directly.
